I'm not sure if this is the reason, but do make sure that your /etc/ 
w3c/validator.conf has the line:
Base = /Library/WebServer/Documents/validator

** without a # at the beginning **

Apparently the Base directory is not set and the validator is using  
the default.


… or, indeed, as Chuck suggested, you could you the standalone mac app  
he built, unless you need the web service capabilities of the  
validator (e.g to build an app upon it).
