br within form passes XHTML 1.0 transitional validation but fails HTML 4.01 transitional

If I read the documentation correctly <br> (or <br /> as appropriate)
cannot be directly contained within a form element, but XHTML 1.0
transitional validation seems to think it's OK. (With Markup Validation
Service v0.7.1)
