Well spotted! You are correct as it the test can pass un-noticed giving 
a false positive.

There was a brief discussion about this at one of the telephone 
conferences and the Working Group agreed to change the test to a value 
other than the default one.

The change will appear in the next release of the SVG Tiny 1.2 Test Suite.
