In comment, I see serious problems with a policy that can make free software development against specific standards impossible. Would it not be discriminatory for a patent licenser to charge a fee to commercial users but not to open source developers? Free software has made basic, important contributions to the infrastructure of the Internet. It's important that this activity be encouraged to continue if the Internet is to remain an open, useful platform. RAND seems to me to be a serious new obstacle to continued free software development against new standards.
