Roughly, we currently have 3 patent policies in effect:
1- W3C Patent Policy: includes all new work that started on or after
February 2004, or ongoing work that was switched to this policy by vote.
2- amended CPP*: for all ongoing work from January 2002 and new work
that started between January 2002 and February 2004.
3- pre-CPP: anything that reached W3C Recommendation status before
January 2002.

Pubrules knows how to deal with documents under 1 and 2. I don't think
it knows about documents under 3. For those, the best approach is to
follow the example of the XML 1.0 4th edition:

<p>W3C maintains a <a
rel="disclosure">public list of any patent disclosures</a> made in
connection with the deliverables of the group; that page also includes
instructions for disclosing a patent. An individual who has actual
knowledge of a patent which the individual believes contains <a
href="http://www.w3.org/Consortium/Patent-Policy-20040205/#def-essential">Essential Claim(s)</a> must disclose the information in accordance with <a href="http://www.w3.org/Consortium/Patent-Policy-20040205/#sec-Disclosure">section 6 of the W3C Patent Policy</a>.</p>

So, to conclude, XML Base needs to include the text above.



* The original January 2002 CPP was modified in February 2004 to better
match the W3C Patent Policy.
