The joint WGs discussed the request you made in http://lists.w3.org/Archives/Public/public-qt-comments/2004Feb/0902.html
and agreed to add clarifying wording for fn:union, fn:intersect and fn:except to cover the case where one of the operands is the 
empty sequence.
