if a duty would only become effective if it has been fulfilled, why would someone fulfill it in the first place? (cf. https://github.com/w3c/poe/issues/211#issue-243981567)

if Alice's obligation to pay 5 € to Bob for downloading his song only becomes effective once she's paid him those 5 €, she could just download it for free, because the obligation wasn't [effective (ɪˈfɛk tɪv) adj.](http://www.thefreedictionary.com/effective).
