I should mention that my previous message is a reiteration of the  
points in
http://lists.w3.org/Archives/Public/public-pfwg-comments/2008JanMar/0085.html

That is, both role='contentinfo' and <footer> are equally invalid in  
HTML 4, which makes the previous answer unsatisfactory.
