I disagree. In practice, authors want full control over the appearance of
toolbars, and I don't think authors will start using menu element until this
issue is addressed. Furthermore, I don't think most of web app developers will
end up using this fallback path.

I agree with Jonas' points and support removing the fallback algorithm and just
have menu, menuitem, and toolbar elements.
