Just for information:
 
The bug is in msxml 4 Core Services SP1
I posted this error to xmlbugs@microsoft.com <mailto:xmlbugs@microsoft.com>
and got the following response today:

Thank you for choosing to use this alias. This is known bug in MSXML 4.0. It
will be fixed in the next MSXML 4.0 Service pack.
