Read the REC carefully, you willl see that 4.4.8 does not apply in the 
relevant cases, but rather 4.4.5, as the table in 4.4 proper makes
clear -- next-to-the-last row, first column.

The DTD for schemas and the tools which accept it as valid are correct.
