does this mean that the 2nd item in [1] which was "Encrypting IV in ECB" is 
reopened?

In that case, I'd prefer it to formulate this even more radically:

- Encrypting IV in EBC and omit the xenc:EncryptedData/@Nonce functionality 
from the spec.
