This was a validator bug, see
http://bugzilla.validator.nu/show_bug.cgi?id=841
and they fixed it by retrofitting the spec to validator behavior. 
Currently the markup is in error (even though it works on all browsers 
that possibly matter); this has been specced in parsing rules, which say 
that the markup creates a "parse error" (and we are expected to 
understand that this means nonconformance), even though browser behavior 
is well-defined.

You can use
http://validator.w3.org/nu/
which has a nice option of silencing unwanted error messages.

Well, it has just one error of this kind, so you can manually ignore it.
