The public mailing list for the Markup Validator probably isn't the  
best place to direct this query, the copyright notice linked from the  
HTML 4.01 recommendation <http://www.w3.org/Consortium/Legal/ 
copyright-documents-19990405> would say be the starting point for  
getting an answer to that question.
