@Andreas, I think we are misunderstanding each other.. 

IE doesn't understand xhtml, it's not a fraud to declare the document for him as text/html because it IS IE that is "in fault". The point is to give him a valid document that he can understand/render.

The point is that the w3c validation only "recommend" declaring the document as "application/xhtml+xml" when using the doctype xhtml 1.1 (it is a valid xhtml 1.1 document) but is not sending the correct headers to do that when creating your documents dynamically (so that every kind of browsers can read your content, which is the point of dynamic content rendering).

Thus, I don't see where is the fraud when you need to tweek your document for a browser that isn't listening to the standards ? You could call it that way however, but then, there is a lot of frauds made specifically for IE to display the content correctly over the web...
