Thanks for pointing out that fact that I ignored.

Meanwhile, that doesn't change the fact that many (if not almost) recent websites do not use anymore .html file extension to display there contents. (Thus, continuing the never-ending complaints about IE...)

And that the validator should specify it's accepted Mime-type(s) to be more accurate, debugging IE isn't it's purpose no?
