Since the validator doesn't actually recognise the FPI in this case, it 
does validate against the the DTD referenced by the SI.  In which case, 
the document is valid if complies with the rules in that DTD (HTML4 in 
this case).  Although it is probably not valid XHTML 1.1, the validator 
does not know that it should use XML mode, nor that the author probably 
intended that FPI to refer to XHTML 1.1.
