Validator bug?

Hi.
The HTML validator considers a redirect in response to a URI in the <!DOCTYPE>
to be a failure. This happens with http://www.w3.org/TR/html4/frameset.dtd if
the case is incorrect in the URI.
Is this appropriate behaviour? One would have thought that the 301 code should
have been processed invisibly and the DTD obtained and used.
