Actually it _is_ an entity reference by SGML rules, but an undefined one,
hence a reportable markup error.

People just often assume that parsing rules like recognizing entity
references don't apply within attribute values or when the recommended
semicolon is not appended. Well, they do apply.

I can't resist the temptation to remark that the page that the OP _knew_
to be invalid carries an image that claims it to be HTML 4.01 conformant.
(I don't really object. The more people do that, the more it becomes
obvious how much worse than futile those images are.)
