Unable to validate an XHTML1.1 document with an empty body

The standard says that the minimal content of a <body> element is

( Heading | Block | List )*

yet when I try to validate a document with </head><body></body> I get a 
validation error stating:

end tag for "body" which is not finished

Is this an error in the validator?
