Bug in encoding detection XHTML 1.0

when I use the <?xml version="1.0" encoding="iso-8859-1"?> for example, when I use Alt+0169 instead of &copy;, it says that there's an unidentifed code, and says that it is using us-ascii. But when I use META, it valids fine. What's wrong?
