It seems that the validator uses a wrong DTD, i.e. its local copy of the
ISO-HTML DTD is wrong. I visited
http://www.cs.tcd.ie/15445/15445.html
(which is referred to in the validator's message)
and copied the DTD from the location announced there,
ftp://ftp.cs.tcd.ie/isohtml/15445.dtd
into my an http addressible location, and using it, via
<!DOCTYPE html system "http://www.cs.tut.fi/~jkorpela/html/15445.dtd">
makes your first document validate, the second one not, as things should
be.
