bug in validator output (or parsing?)

When I validate  
http://creditcardsatchase.com/portal/index.jsp?pageID=homepage,
I get a page  
(http://validator.w3.org/check/?uri=http%3A//creditcardsatchase.com/ 
portal/index.jsp%3FpageID%3Dhomepage)
that says it's invalid.  When I then validate that page, however
(by visiting
http://validator.w3.org/check/?uri=http%3A//validator.w3.org/check/ 
%3Furi%3Dhttp%253A//creditcardsatchase.com/portal/ 
index.jsp%253FpageID%253Dhomepage)

It complains:

Line 99, column 10:
   <ul>    <p><strong>Fatal Error</strong>:  no document type  
declaration ...
             ^

Error: start tag for "LI" omitted

I use the validator via a Konqueror plug-in.  Thanks for providing it.
