validator w3 org bug, unable to detect doctype while provided

I tested the url: http://brlstatx.brlspeak.net/
I applied the advise of the validator, resubmitted, and receive the same fatal err msg.
Is this a bug ? Test it yourself, but please report off-lis since I'm not on this list.
