Cannot Validate XHTML on pages converted to XML by FrontPage 2002

Dear Sirs,
                    I am converting www.wintaxpros.com to XHTML using the FrontPage 2002 "XML" format conversion.

        The HTML TIDY keeps identifying the "Doctype" in lower case error and "nbsp" errors.

        Each time I save in FrontPage, the saving process puts "DOCTYPE" to lower case and the "#160" back to "nbsp".  See http://www.wintaxpros.com/Specials/WTPspecial---01__01.htm 

        I have tried to join the both Usenet newsgroup [Asks for a newsgroup server--"I have now knowledge of this"], and the HTML Writer's Guild comes up with a "HTML REFER Error"

        Where can I go from here
