The validator isn't an all purpose HTML approval tool, it does a
very specific thing -- checks for compliance with the HTML spec
using an SGML parser.
The problem of "making sure text is visible" is a tricky one, and
even more complex when style sheets (which the validator does not
check) are introduced.
You may want to suggest this to the various web site "garages" and
tune-up evaluators, or perhaps Bobby http://www.cast.org/bobby/
