"name" element in HTML4.0

Encountered something odd while validating my documents...

According to the HTML4.0 Specs, the attribute "name" for a form has been
added for backwards compatibility, and I use that element to be able to
refer to it using JavaScript. The validator however says that there is no
such element in HTML4.0 Transitional. The specs say differently, maybe an
oversight?
