You should be more specific. The CSS Validator perfectly recognizes
byte-order marks in "text/css" ressources. It does not support UTF-8
BOMs in XHTML documents served as "text/html" with no "charset"
parameter. This is a known bug, see
<http://www.w3.org/Bugs/Public/show_bug.cgi?id=1762>.
