You could explain what kind of practical badness to the operation of
the Web would result from linking being subject to permission or from
legal liability arising from loading a Web page when you can't know
what exactly you are going to load before you've loaded it.

The TAG could pretend that political issues aren't technical enough,
for the TAG to say anything, but
http://www.w3.org/2001/tag/doc/deeplinking.html is precedent that goes
the other way and talks about a court case and about "public policy".
