XPointer uncertainties - Any implications for SVG??

I was wondering if anyone has considered whether the implications of the 
present difficulties which surround XPointer have any implications for the 
progress towards an SVG REC.

The background is that XPointer returned to Working Draft stage from CR.

The wider issue which has generated some vigorous discussion on the XML-DEV 
mailing list relates to the possibility that Sun has a patent which may 
possibly affect part/all of XPointer.

Since SVG makes use of XPointer (see e.g. Section 5.3.1) does the (possibly 
applicable) Sun patent affect SVG in any way?
