The number of layers is determined by the number of comma-separated values in the 'background-image<http://dev.w3.org/csswg/css3-background/#background-image>' property. Note that a value of 'none' still creates a layer.

IE9 conforms to the specification.

Besides, Webkit still calculates the number of background layers the "old" way, even on the latest nightly, so it would be safe to assume that the issue is still pending? Presto and Gecko comply with the spec and I didn't test what IE9 does.
