Not W3C itself, but its members do, which amounts to the same thing.

Those patent-holding members form the the W3C committee drafting W3C's patent 
policy.  So while the public may not be entirely clear on some of the 
details, the public clearly understands the concept that W3C is proposing to 
screw them.
