Hey Mark,

I certainly respect your opinion and I can easily see value either way 
(allowing an empty instance for ease of scripting vs. requiring a root 
element so that we don't have to further detail how instance('foo'), for 
example, should work if foo is emtpy, etc.).  But I also feel that we 
should get this resolved in the working group such that everyone agrees 
and so that we all implement this similarly.  This isn't just a slight 
difference in an undefined behavior between processors where some may 
throw an event and some may not...it is the difference between handling 
a form perfectly well and a fatal exception that stops processing.

Again, I don't really care which way we go...but we should all go the 
same way.
