multiple instances within a model: instance() forgotten?

Hi,

The answer that was given to me in 
http://lists.w3.org/Archives/Public/www-forms-editor/2002Jul/0048.html 
uses a new XPath function, instance().

However, instance() is not defined in the latest draft, it is just 
mentioned in chapter 7.4.
