Annotea protocols page: missing XML declaration?

In the Annotea protocols page, 
http://www.w3.org/2001/Annotea/User/Protocol.html, there are examples of 
POSTing XML to the annotations server (eg Figure 1, Figure 2). It looks to 
me as though the XML should start with an XML declaration (<?xml 
version="1.0"?>), otherwise I get an "was unable to interpret parameter 
<r:RDF..." error.
