How would Netscape cause them to be non-compliant with Section 508?
What you are saying is terribly confusing. There's no reason that
you would remove <label> (and thus be out of compliance with Section
508) merely because Netscape does not support it.

It doesn't? What makes you say that? Are you saying that Netscape 6
does the equivalent of this?

      label { display: none; }

...or are you saying something different?
