The spec says something like "once you have the set of devices that satisfy the criteria, the UA picks one". It could say something like "once you have the set of devices that satisfy the criteria, the UA tries to open each one in turn until one succeeds or all fail". That would preserve the model, and get a working device. (Mostly Youenn's suggestion.
