Royalty-Free for GPLed-softw?

  Could it help if the patent holder issues a
GPL-compatible license? ie if the patent is autimatically
granted a irrevocable royalty free license to any software
issued under GPL licenses. 

 In this way companies could have three options: to fight, to
pay, or to release the source code.
