New Failure Techniques for SC 1.3.1

I have been trying to complete the failure tests for Guideline 1.3.  I 
have completed all but one of the failures for SC 1.3.1 [1].  I would 
appreciate it if folks could review the following three failure 
techniques. 

General Failures
Failure due to using space characters to format tables in simple text 
content. [2]
Failure due to using space characters to create multiple columns in simple 
text content [3] 

HTML failures
Failure due to using th elements, and summary attributes in layout tables 
[4] 

I don't understand what is meant by the general failure, "Failure due to 
ambiguous hierarchical lists in simple text content.". Can someone else 
work on that one or provide more details?
