The tests themselves ought to be dual 3-clause BSD and W3C Test Suite 
License.

Paraphernalia (which for our purposes I'm going to rule includes 
wptserve) and dependencies just need to be open source (I guess 
preferably OSI certified — all those mentioned above are).
