Tim, thanks for the quick response.  I see your point but I am not fully
convinced that the spec allows the success or failure of static
optimizations/checking to alter the semantics of the expression.  

It seems K2-SeqDocFunc-4 is one of the fn:doc tests you are remembering:

It allows both FODC0002 and XPST0001. So, at the very least, there is a long
standing precedent for allowing this.  I will update the tests I mentioned to
include both results as you and O'Neil suggest.  

Also, finding this test led me to a related bug:

Mike Kay essentially raises the same issue that I have (problem (c) in the
description).
