I agree with what you say in Comment #29, but think that that if 

1 + <e>2</e> 

can't give the answer 3 in static typing mode then the static typing mode is
too inconvenient to use.  

Assigning the type element(*, xs;typed) to elements in construction mode
'preserve' solves this problem and renders the static typing mode more useful, 
and perhaps even usable.
