The XSL WG felt that it would be inappropriate to introduce a change/erratum to
XPath that is needed only because there is a problem in XQuery. Therefore the
syntax 

/ < 5

should continue to be allowed in XPath, despite the fact that it will no longer
be allowed in XQuery.
