I think you would like to replace “expression will necessarily raise a 
dynamic or type error” with “expression will necessarily raise a type 
error” since the dynamic errors are dealt with already and are not 
dependent on the static typing feature. But otherwise I am satisfied.

Michael, 
In a conference call on Feb. 11, 2004, the Query Working Group responded 
to your issue by adding the following paragraph to Section 2.5 of the 
XQuery document: 

"If the Static Typing Feature is not in effect but an implementation can 
nevertheless determine during the analysis phase that an expression will 
necessarily raise a dynamic or type error, the implementation may report 
that error during the analysis phase." 

Please let us know whether you are satisfied with this resolution of your 
issue.

Technical 

Please add a sentence of the form "If an implementation can determine
during analysis phase that an expression is always raising a dynamic or
type error (if static typing option is not used), that error can be
reported during the analysis phase".
