using a "q" element to make the prose italic when it is not a quote is an improper usage of html. It is not described by the formal grammar.

Markup validators and checkers are tools. The validators could issue warnings for things, but people have a tendency to dismiss tools sending too many warnings (there are a lot of other things which could be checked too.)
