I have completed my review for the Data on the Web Best Practices
http://www.w3.org/TR/dwbp/ document. I think some information about the
accessibility of the data formats needs to be included. 

 

Background

In September 2012 in the US the Affordable Care Act (ACA and HIPPA/HITECH)
law prompted Health and Human Services to propose a rule/regulation to
"adopts standards, implementation specs, and certification criteria for
Electronic Health Record (EHR) data and technology. Under the 'Meaningful
Use
<http://www.healthit.gov/providers-professionals/ehr-incentives-certificatio
n> ' rules (in Stage 2) for secure exchange of information between providers
and patients to support better care across the nation."  That rule requires
WCAG 2.0 Level A for EHR - an electronic health record is a collection of
data.

 

Those rules are now in effect, see the 2014 Edition HER Certification
Criteria

eria_mustage2.pdf) which requires:

*         Under Meaningful Use 42 CFR 495.6(j)-(m) Stage 2 Objective:
Provide patients with the ability to view online, download and transmit
their EHR in accordance/conformance with the identified standards - which
includes  WCAG 2 Level A.

 

According to 45 CFR Part 170 Electronic Health Records (EHR) Certification
Criteria, 2014 Edition, Release 2, Final Rule, September 2014:

*         Any capabilities of the HER technology that permit patients and
their authorized to view, download and transmit health information/data must
be in conformance with WCAG 2 Level A.

*         And, EHR must permit patients and their authorized representatives
to view the provider's name and office contact information and Common MU
Data Set using ambulatory EHR technology; and the admission and discharge
dates and locations, discharge instructions, and reasons for
hospitalization, and the Common MU Data Set using inpatient EHR technology,
must conform with the WCAG 2 Level A standard.

Data on the Web Best Practices 

Perhaps add a section/link and/or specific content in..

 

*         Section 6: Data on the Web Challenges - on the diagram for Data
Formats, What data formats should I use? - here perhaps an item could be
added to include "include an optional a plain text format" OR "include at
least one WCAG 2 conforming data format type".

 

*         Section 9.8: Data Formats. 
NOTE: The "nonproprietary data format" (Best Practice 13: Use
non-proprietary data formats) section partially addresses accessibility -
but not really - unless this section) is enhanced to talk about CSV and/or a
plain text file type as being an accessible option.

OR

NOTE: The "available in multiple data formats" (Best Practice 14: Provide
data in multiple formats) section could address accessibility - for
identifying "for accessibility ensure that CSV and/or a plain text file type
is always an option" OR "include at least one WCAG 2 conforming data format
type".
