Wouldn't you add the ARIA role as well using JavaScript in that case? 
Since it would be lying to AT readers to have the ARIA role hard-coded, 
if JS is disabled.

If added with JS, *the validator* won't complain.

However, your example proves that *the spec* should allow usage of 
dynamically created ARIA roles in ways that hard coded ARIA roles should 
not be allowed to be used.
