It looks like the new licenses came up in August 2008:
 http://www.w3.org/Consortium/Legal/2008/04-testsuite-copyright.html

As long as you don't call your copy the "authoritative w3c test suite"
or make performance claims with respect to a w3c spec, you can use the
3-clause bsd license.
