If you change the generated-DOM so that xmlns attributes are put in a namespace
html[xmlns] will no longer match as that only selects xmlns attributes not in a
namespace.

I think we have explained this problem enough by now. Being ignorant about it
whenever the year passes by starts to get annoying.
