This basically all but screams "this is an exception". We don't want to make it sound like it's ok to use the summary="" attribute; even though it is technically conforming and not technically obsolete, it's still strongly discouraged. It would be counter-productive to make it sound like it was ok. We could make it obsolete again, if the problem is that it is an exception.
